This Information Notice has been prepared pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data (“KVKK”), titled “The Obligation of the Data Controller to Inform”, and the Communiqué on the Principles and Procedures to Be Followed in Fulfilling the Obligation to Inform, in order to inform you about the purposes for which your personal data are processed by Yücel Cultural Foundation (“YCF”), the purposes for which such data may be transferred, the method and legal grounds for their collection, and your rights under Article 11 of the Law.

Your personal data are collected, wholly or partially through automatic means, or through non-automatic means provided that they form part of a data recording system, via the completion of the Reservation Request Form in physical or electronic form, as well as through e-mail, telephone, the website, and face-to-face communication channels.

Your personal data are processed on the basis of the following legal grounds set out in Article 5/2 of the KVKK:

  • (c) Where processing is necessary for the establishment or performance of a contract, provided that it is directly related to the parties to the contract (establishment of the reservation and usage agreement).
  • (ç) Where processing is necessary for the data controller to fulfil its legal obligations.
  • (f) Where processing is necessary for the legitimate interests of the data controller, provided that such processing does not harm the fundamental rights and freedoms of the data subject (management and security of the Center, execution of the Foundation’s activities).

3. Purposes of Processing Personal Data

The personal data you provide through the Reservation Request Form (such as Name, Surname, Institution Name, Contact Information, etc.) are processed for the following purposes:

  • Management of Reservation Processes: Receiving, evaluating, approving, and tracking your reservation requests regarding the Performance Center and its annexes.
  • Performance of the Contract: Preparing, executing, and ensuring full compliance with the rental/usage agreement associated with an approved reservation.
  • Communication: Ensuring fast and accurate communication with you concerning your reservation process, providing information, and resolving potential issues.
  • Center Management and Security: Planning and organizing the internal operations of the Performance Center, ensuring physical security, and resolving potential legal disputes.
  • Financial Obligations: Tracking, invoicing, and carrying out accounting procedures related to the fees arising from reservation and usage.
  • Legal Obligations: Fulfilling the Foundation’s obligations arising from applicable legislation (tax laws, commercial regulations, etc.).

4. Transfer of Personal Data and Purposes of Transfer

Your personal data may be transferred to the following persons or organizations in accordance with the purposes stated above and the conditions set out in Articles 8 and 9 of the KVKK:

  • Authorized Public Institutions and Organizations: Official authorities and judicial bodies legally authorized to request such data.
  • Business Partners / Service Providers: Third-party consultants and service providers from whom services are obtained in areas such as accounting, legal support, and information technologies (server, hosting, security), as required for the execution of operational processes.

Transfers of personal data abroad may be carried out only in cases of necessity and only with your explicit consent or in the presence of other legal grounds stipulated under Article 9 of the KVKK and relevant decisions of the Personal Data Protection Board.

5. Rights of the Data Subject

Pursuant to Article 11 of the KVKK, you may apply to our Foundation and exercise the following rights regarding your personal data:

  • a. To learn whether your personal data are processed,
  • b. To request information regarding such processing,
  • c. To learn the purpose of processing and whether your data are used in line with such purpose,
  • ç. To learn the third parties to whom your personal data are transferred within Türkiye or abroad,
  • d. To request the rectification of personal data that are incomplete or inaccurate,
  • e. To request the erasure or destruction of your personal data under the conditions set forth in Article 7 of the KVKK,
  • f. To request notification of the actions taken pursuant to subparagraphs (d) and (e) to third parties to whom the personal data have been transferred,
  • g. To object to the occurrence of a result to your detriment through the exclusive analysis of your personal data by automated systems,
  • ğ. To claim compensation for damages arising from the unlawful processing of your personal data.

6. Method of Application

To exercise the rights listed above, you may submit your request by completing and signing the “Data Subject Application Form” and delivering it to Alemdar Mah. Alemdar Cad. No: 3, 34110 Sultanahmet, Fatih – İstanbul, in person; sending it via notary public; or submitting it in electronically signed form to info@yucelkulturvakfi.org.

Our Foundation shall conclude the application free of charge as soon as possible and within no later than thirty (30) days, depending on the nature of the request. However, if the process requires an additional cost, the fee determined by the Personal Data Protection Board may be charged.
